Zicam co-creator pleads not guilty in avian flu drug case

Charles B. Hensley, the Redondo Beach co-inventor of the cold remedy Zicam, was arraigned Thursday for allegedly illegally importing a new, misbranded, unapproved drug advertised as a treatment for the Avian flu.

He faces up to 28 years in prison if convicted of transporting an herbal product called Vira 38 from Hong Kong and selling it across the United States. The drug promised to stop flu symptoms and prevent H5N1 infection - commonly called bird flu, according to statements from Hensley's company, PRB Pharmaceuticals, Inc. of Cypress.

Hensley, 57, pleaded not guilty to federal charges in U.S. District Court in Los Angeles on Thursday and was released on his own recognizance on $5,000 bond. His trial is set to begin on July 26.

Hensley was arrested Wednesday at his Redondo Beach home after a 12-count grand jury indictment was issued against him on May 20. He was taken into custody by members of the Southern California Import Task Force, which includes Food and Drug Administration agents, United States Postal Service officials and Los Angeles Police Department investigators.

A Los Angeles federal grand jury accused Hensley of four felony counts of illegally importing an unapproved drug, and four misdemeanor counts each of introducing an unapproved new drug into interstate commerce and of introducing a misbranded drug into interstate commerce, prosecutors said.

The prosecution rests on the fact that the drug was being sold online as a cure for the flu even though it was not approved by the U.S. Federal Drug Administration.

A statement from PRB Pharmaceuticals calls Vira 38 an "over-the-counter broad spectrum anti-viral medication (that is) known for its effectiveness in treating and preventing influenza. Vira 38 has recently been shown to contain compounds that inhibit the bird flu."

In 2005, the FDA warned consumers and PRB Pharmaceuticals, Inc. against using or selling Vira 38. The agency said that there was no scientific evidence showing that the drug was either safe or effective in treating influenza or the H5N1 virus. Although the product was herbal, the FDA considers it a drug because its manufacturer claimed it treated, cured or prevented flu viruses.
